Dispute adjudication in Austrian conditions of contract for underground works / Der TSV im Spannungsfeld von Baugrundrisiko und Sphärentrennung

The institution of a neutral Tunnelling Expert (TE) has proven to be of benefit to Austrian Tunnelling Projects. However, misdevelopments have been observed during recent years, which lead to setbacks and obstructions against utilizing its full potential. On the basis of practical experiences, the reasons and backgrounds are explained and options for improved collaboration of the participants by targeted involvement of the TE are shown. Die Institution eines neutralen Tunnelbautechnischen Sachverständigen (TSV) hat sich im österreichischen Tunnelbau bewährt. In den letzten Jahren sind jedoch einige Fehlentwicklungen festzustellen, welche die Ausnutzung des vollen Potenzials dieser Funktion behindern. Anhand von praktischen Erfahrungen werden die Ursachen und Hintergründe erläutert und Möglichkeiten im Hinblick auf eine verbesserte Kooperation der Projektbeteiligten durch zielgerichtete Einbindung des TSV aufgezeigt. Dabei wird nicht nur auf strukturelle Themen, sondern auch auf die Mechanismen des sozialen Systems bei der Errichtung von Bauprojekten eingegangen.
